DMCA Copyright Policy

EyeCandyVids respects the intellectual property rights of others and expects the same of everyone who uses the platform. This page explains how to report material you believe infringes your copyright, how to respond if your material is removed, and what happens to repeat infringers.

1. Our position

EyeCandyVids is an online service provider that hosts material uploaded by independent creators. We do not review every upload before publication for copyright ownership. We respond to properly submitted notices of claimed infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. §512.

2. Designated agent

Our designated agent is also registered with the United States Copyright Office DMCA Designated Agent Directory. Notices sent to any other address may not receive a timely response.

3. How to submit a notice of claimed infringement

To be effective under 17 U.S.C. §512(c)(3), your written notice must include substantially all of the following:

1. A physical or electronic signature of the copyright owner or a person authorised to act on the owner’s behalf.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
3. Identification of the material claimed to be infringing, with enough detail for us to locate it — please include the full URL of each item.
4. Your contact information: name, mailing address, telephone number and email address.
5. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.

4. What we do when we receive a valid notice

• We remove or disable access to the identified material expeditiously.
• We notify the creator who uploaded it and forward a copy of the notice, which may include your contact details.
• We record the notice against the uploading account for the purposes of our repeat-infringer policy.

5. Counter-notification

If your material was removed and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification to the agent above. To be effective under 17 U.S.C. §512(g)(3) it must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
4. Your name, mailing address and telephone number, and a statement that you consent to the jurisdiction of the United States District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original notice or their agent.

If we receive a valid counter-notification we will forward it to the person who submitted the original notice and advise them that we may restore the material in 10 to 14 business days unless they notify us that they have filed an action seeking a court order to restrain the allegedly infringing activity.

6. Repeat infringers

We maintain a repeat-infringer policy. Accounts that are the subject of repeated valid notices of claimed infringement are subject to escalating action, up to and including permanent termination and forfeiture of any unpaid balance associated with the infringing material. We reserve the right to terminate an account immediately in cases of clear, wilful or large-scale infringement.
